
New Delhi: India has given formal assurances to the Belgian government in the process of extradition of Punjab National Bank ( PNB ) scam prime accused Mehul Choksi from Belgium. India’s Ministry of Home Affairs ( MHA ) sent a letter to the Belgian Ministry of Justice and the relevant judicial authorities, detailing the conditions for Choksi’s detention in India. The assurances have been given as part of India’s extradition request in the Central Bureau of Investigation (CBI) case related to the Rs 13,500 crore PNB scam .
The Home Ministry held talks with the Maharashtra government and the prison administration
The Home Ministry, in consultation with the Maharashtra government and prison authorities, outlined the material, medical and procedural safeguards for Choksi’s custody. Choksi will be kept in barrack number 12 of Arthur Road Jail in Mumbai, which is meant for non-violent and economic offenders. The barrack is 20×15 feet, with provisions for ventilation, CCTV surveillance, 24×7 medical facility, a 20-bed prison hospital and permission for private medical treatment.
Can be sent to India with these conditions
These assurances are given to address human rights concerns, particularly the prevention of torture or inhuman treatment under Article 3 of the European Convention on Human Rights. Belgian courts, particularly the Chambers of Indictment in Antwerp, will review these assurances. If the conditions and legal requirements are met, Choksi can be extradited to India. Choksi was arrested in Belgium in April 2025, and is the main accused in the scam along with his nephew Nirav Modi.
Police say the investigation and extradition process are ongoing, and Choksi’s legal team is seeking bail on health grounds.
